Terms of Service

Fair terms for a fair platform. You own your data, you can leave anytime, and these terms will never claim otherwise.

1. Agreement to Terms

Welcome to CyberEco. These Terms of Service ("Terms") govern your access to and use of the CyberEco Hub website, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use the Service.

CyberEco Hub is the identity and data home of the CyberEco ecosystem: it provides your account, single sign-on, and a unified data layer that connected ecosystem applications (such as expense splitting) build upon. The Service is designed around a founding principle: your data belongs to you, not to us (see Section 5).

2. Account Creation and Access

2.1 Registration and Account Security

To use most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account or other security breach. The Service provides a security activity log so you can review sign-ins and sensitive actions on your account.

2.2 Connected Ecosystem and Third-Party Applications

The Service allows applications — both CyberEco ecosystem apps and third-party apps built by developers on our platform — to connect to your account through an authorization flow (OAuth). An application only gains access to your data when you explicitly authorize it, and only within the scope you grant. You can review and revoke connected applications at any time from your account.

Developers who register applications on the Service agree to use user data only within the scope granted, consistent with the privacy and data-ownership principles of the platform, and are prohibited from extracting, reselling, or otherwise monetizing user data.

2.3 Age Requirements

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Acceptable Use

You agree that you will not:

  • Use the Service for any illegal purpose or in violation of any applicable law;
  • Violate or encourage others to violate the rights of third parties, including intellectual property and privacy rights;
  • Post or distribute content that is unlawful, defamatory, harassing, threatening, hateful, or otherwise abusive toward other users;
  • Attempt to access accounts, data, or areas of the Service that you are not authorized to access;
  • Interfere with security-related features of the Service, including circumventing permission checks, rate limits, or authentication;
  • Use robots, scrapers, or other automated means to access the Service outside of the documented APIs and their rate limits;
  • Send spam or unsolicited communications through the Service;
  • Misuse the developer platform to harvest, profile, or exploit other users' data;
  • Engage in conduct that harms the Service, its users, or the community, or exposes them to liability.

We build technology for human flourishing; using it to exploit others violates both these Terms and the purpose of the platform.

4. Your Content

4.1 Content Responsibility

The Service allows you to create and store information such as expenses, groups, transactions, profiles, and other material ("User Content"). You are solely responsible for your User Content, including its legality, reliability, and appropriateness. When you share User Content with other users (for example, in an expense group), you are responsible for having the right to share it.

4.2 You Own Your Content — Limited Operational License Only

You retain full ownership of your User Content. This is the core differentiator of the Service and is enforced by our architecture, not just promised in these Terms.

Unlike typical platform terms, we do NOT take a broad, transferable, sublicensable license to use, modify, or promote your content. You grant CyberEco only the minimal, non-exclusive, revocable license necessary to operate the Service for you: storing your data, transmitting it to you and to people you explicitly share it with, backing it up, and displaying it within the applications you use. That license ends when you delete your content or your account, except for limited persistence in backups and in other users' shared records (e.g., a group expense you settled with someone else).

We will never sell your User Content, use it for advertising, or claim rights over it beyond what is described here.

4.3 Data Portability and Deletion

You may export a copy of your data in standard formats (JSON, CSV) at any time, and you may request deletion of your content or your entire account. Self-service deletion is coming soon; today you can request it by emailing info@cybere.co. No feature of the Service is designed to lock you in. See the Privacy Policy for what the export currently includes and for deletion details.

4.4 Content Moderation

We do not monitor private User Content as a matter of course. We reserve the right to remove content or restrict accounts where content is reported or detected as violating these Terms or applicable law, and to comply with legal obligations.

5. Data Ownership and Digital Sovereignty

The Service is governed by the CyberEco tenets, the first of which is Digital Sovereignty: users own their data — period. In practical terms:

  • Every data type in the platform supports export in standard formats and supports deletion;
  • Access to your data is permission-checked on every operation — nothing is shared unless you shared it;
  • The platform architecture is deliberately storage-agnostic so that your data is not locked into any vendor, including us;
  • If a future change to the Service would make it harder for you to leave, that change violates our own tenets and these Terms' spirit.

In the event of a conflict between this Section and any other provision of these Terms, this Section prevails.

6. Intellectual Property

6.1 CyberEco Intellectual Property

The Service's software, design, and original content (excluding User Content) remain the property of CyberEco and its contributors. The source code is publicly available and licensed under the terms stated in the repository. Nothing in these Terms restricts rights granted to you by those licenses.

CyberEco's name, logo, and trademarks may not be used to imply endorsement or affiliation without prior written consent.

6.2 Service License

Subject to these Terms, CyberEco grants you a limited, non-exclusive, non-transferable license to access and use the hosted Service. This license does not include resale of the hosted Service, or use of data mining or extraction tools against other users' data. Your rights to the underlying open-source software are governed separately by its license.

6.3 Copyright Complaints

If you believe content on the Service infringes your copyright, contact us (Section 14) with: identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a good-faith statement that the use is unauthorized, a statement of accuracy made under penalty of perjury, and your physical or electronic signature.

7. Third-Party Services

The Service may contain links to, or integrations with, third-party websites or services not controlled by CyberEco (including third-party apps you authorize via OAuth). CyberEco is not responsible for the content, privacy policies, or practices of third-party services. We advise you to read the terms and privacy policies of any third-party service you connect to your account. You may revoke a third-party app's access at any time.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

CYBERECO DOES NOT WARRANT THAT (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

The Service includes financial calculation features (such as expense splitting and settlements) provided for convenience. They do not constitute financial, tax, or legal advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CYBERECO, ITS MAINTAINERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; IN THOSE JURISDICTIONS, LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless CyberEco, its maintainers, and contributors from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content, or your violation of any third-party right.

11. Termination

By you: You may stop using the Service at any time, and you may request deletion of your account (self-service deletion is coming soon; see Section 4.3). Before deletion, you can export your data (Section 4.3). Upon deletion, your data is removed as described in the Privacy Policy.

By us: We may suspend or terminate your account for breach of these Terms, giving prior notice where reasonably possible. Even upon termination for breach, we will honor a reasonable request to export your data unless legally prohibited — data ownership survives termination.

Provisions that by their nature should survive termination (including Sections 4.2's ownership commitments, 5, 8, 9, and 10) survive.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Mexico. Any dispute arising from these Terms shall first be attempted to be resolved informally by contacting us (Section 14); failing that, disputes shall be resolved in the competent courts of Mexico City, Mexico.

Our failure to enforce any right or provision of these Terms is not a waiver. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

13. Changes to Terms

We may modify these Terms. If a revision is material, we will provide at least 30 days' notice before the new terms take effect, through the Service. Changes will never retroactively grant us rights over your data (Section 5). By continuing to use the Service after revisions become effective, you agree to the revised Terms; if you do not agree, you may export your data and request deletion of your account.
